Do you have your affairs in order?

July 2, 2009 · Leave a Comment

Q. The sudden and unexpected death of Michael Jackson raises many questions but one the legal community, I mean the sincere lawyers amongst us who care for children, ask is: do you have your affairs in order? Should you die unexpectedly, do you have a will designating who will have legal custody of your children? Do you have your assets defined to make sure the estate is safe? Do you in other words made sure that when you go, your kids do not have to face an uncertain future aside from all the trauma and grief?

A. Thank you for asking this question. Every day I meet with people of all ages and backgrounds who have not prepared a Will. Please take the time and get ‘er done. It’s your last love letter to your love ones. If you’ve been married before, perhaps you have children from a previous relationship, you know you need a Will. I know many of you are ‘waiting’ to complete a Living Trust, in the meantime get your Will done.

Please know that one of the best benefits of a Pre-Paid Legal membership is a Will Preparation for both spouses, a Living Will (remember Terri Schiavo) for both spouses and a Durable Power of Attorney for both spouses, all included in the small monthly membership.

So contact an experienced estate planning attorney today.  Avoid using a boilerplate online form or from Staples, etc.  Also don’t rely on a friend or relative who may very well be an qualified in other areas of law but is  not an expert in  Trusts and Estates.  Please don’t delay.  I truly hope this helps someone.
